With a little over a year to go until IR35 reform is enforced for the private sector in April 2020, it is paramount that UK private sector businesses and recruitment agencies take the time awarded to them to prepare for the legislation.
From 6th April 2020 the responsibility for determining employment status for tax under the IR35 rules will become that of the engager, whilst the fee-payer (usually the recruitment agency) will be responsible for deducting the appropriate taxes.
From now until then, private sector businesses must keep up-to-date on information including the expected consultations due in 2019, but not delay their preparations. Audits of the contingent workforce and the impact reform will have on your business can be completed well in advance of the reform, ensuring any systems and processes needed are in place ready for the changes.
In addition to ensuring you have your house in order, preparation will also help to put your contracting workforce at ease knowing you are prepared to take a fair and compliant approach to the reform, preventing mass walkouts and claims for loss of earnings/employment rights.
